Uninsured/Underinsured Liability

Overview

Uninsured/underinsured motorist (UM/UIM) protection provides coverage for the driver and passengers involved in a collision with another driver who does not have enough liability insurance coverage to pay for the damages or injuries they cause. 



UM/UIM coverage also pays if the driver is in a hit and run accident and the other driver cannot be found to pay for damages. Because UM/UIM coverage is generally mandatory for ride-share drivers, the growth of the ride-sharing industry and the proliferation of delivery services on the roadways have resulted in a corresponding increase in the number of UM/UIM claims.

Unlike the negligence claims that typically arise from motor vehicle accidents, a UM/UIM lawsuit is filed directly against the insurance company. Because it is based on the insurance contract between the policyholder and the insurance company, the claimant is generally entitled to recover attorney’s fees. Because those attorney’s fees may accumulate rapidly, the firm’s attorneys will work to reduce the fees and negotiate the claim quickly, if possible.
